That sounds like a good plan; however, it will not work. In the first place, at this time one cannot file an Offer on 2012 taxes because they are not due until April 15, 2013. In order to make an Offer, one will have to file the 2012 taxes whether or not they are paid when filed, because a taxpayer must be current with all filings at the time the Offer is submitted. If additional tax is owed for 2012 but cannot be paid at the time of filing, the taxpayer must wait until at least September to submit an Offer In Compromise that includes 2012. Also, since he must have owed additional tax for several years he must also begin paying estimated tax for 2013 for the IRS to consider an Offer.
