If a spouse has to transfer the marital home to the other spouse by Court Order and then t tax is assessed against him after the divorce is final, then the lien does not attach to receiving spouse’s house. The only exception to this is if there was fraud involved or the divorce was a sham to avoid his debt. After transferring the property to the receiving spouse, the husband had no control over the house and thus the lien could not legally attach to the property.
